Water Commissioner arrested on assault charges

LINCOLN - A member of the Board of Water Commissioners has been arrested for charges of domestic violence following an altercation in the parking lot of Bob & Timmy's Grilled Pizza and Wide World of Indoor Sports in North Smithfield.

Eric Fox, 35, of 2 Cass St., Lincoln, was arrested on March 24 and charged with domestic simple assault/battery, domestic disorderly conduct, simple assault or battery, and disorderly conduct, after he allegedly pushed his ex-wife to the ground and punched her boyfriend.

His father, Edward Fox, was also taken into police custody for disorderly conduct.

Fox, a Johnston firefighter, is a lifelong resident of Lincoln. Ousting incumbent Jean Kay, he was elected to the Water Commission, District 2, in November.

He was arraigned in 3rd District Court on April 23 with a plea of not guilty.

When contacted by The Breeze, Fox said he had no comment.

According to a report from Patrolman Joseph Scotti of the North Smithfield Police Department, Fox's ex-wife, Michele Fox, and her boyfriend, Jonathan Kanicki, were involved in an altercation with Fox and his father, Edward Fox, following a child's soccer game. Fox and Michele have two boys, ages 8 and 5.

An argument started between Edward Fox and Kanicki, the report states, after one of the boys allegedly told his mother that his grandfather had called Kanicki "the F word." Michele then reportedly told Fox to "speak with his parents about swearing in front of the kids."

Fox told police that when he arrived at the pizza place across the parking lot from the sports facility, he saw his father walk outside to Michele and Kanicki and initiate a verbal argument. Both Fox and Michele tried to get between the two and end the fight, the report states, but then Fox got involved.

"Eric stated that he was chest to chest with (Kanicki), and eventually put him in a bear hug," the report states. "Eric indicated that he was unsure if he delivered closed fist strikes to (Kanicki) while he had him in a bear hug. Eric also stated that at no time did the altercation between himself and Michele become physical."

The men walked away from one another, the report states, but Michele told officers Fox and Edward then followed her and Kanicki to the car.

"Michele stated that she attempted to get in between Eric and her boyfriend but Eric pushed her out of the way," the report states, "which caused her to hit the vehicle and fall to the ground, scraping her knees."

Afterwards, Kanicki called police, the report states, and was then allegedly assaulted. Kanicki told police that Fox "charged at him while he was on the phone, put him in a head lock and started punching him in the ribs, stomach and neck."

He then allegedly "took substantial verbal abuse from Eric in the parking lot."
